Advice please!

Hi all,

I have recently left a job and have started a new one... however.... I am worried my old employer still thinks I work for them and hasn't realised I've left. I formally handed my notice in to my area manager though, at first, had no reply from them. I called the head and payroll to inform them that I would be working my notice period and leaving the company. Head office told me that I would need to contact my area manager (which I had already done but had no response). I contact her again and asked her if she had received my resignation letter, whether or not my finish date was correct and to please respond to me as I wasn't aware if she had recieved these. This time around she did reply to me with a very blunt email saying yes she had recieved it and was working on it. All of these emails were copied to head office. After hearing back from her I worked my notice period and left with out further communication. I did not think this was strange as I the company have never been good at communicating with me and I rarely heard anything from my area manager.

I'm worried the company still think I'm employed by them and working for them as I am continually receiving news letters and generic emails that are sent to the whole company. I can also still log in to my all of my employee accounts with them, and my last pay check was as usual, no P45. I have contacted head office and told them I no longer work for them though all they can say to me is it is out of their hands and my area manager needs to sort it.

I am worried that if they pay me again at the end of April is there some legal battle I'm at risk of getting involved in. Would I have to pay the money back? There are also various benefit schemes with the company that I would like to still use though these are for employees only, which I am not, I know this is bad but the idea is very tempting.

Please could someone advise on this!

    I think you must know the answers to this and if you are hoping ANYONE is stupid enough to say it is OK to do what you say I think you will wait a LONG TIME for it.

    You have done all you need to do and have worked your notice so regarding that you have no comeback from your cold company BUT if you do get a wage from them other than the monies due {including any holiday pay} that wage is NOT YOURS and will need to be paid back.
    I would suggest that should it happen contact HO, tell them what has happened and ask how you can pay bin back to them. YOU ARE NOT ENTITLED TO A WAGE YOU HAVE NOT WORKED FOR and they can/will take legal action to claw it back. So DO NOT RISK spending any of it as IT IS THEFT.
    Re company benefits... YOU NO LONGER WORK FOR THE COMPANY SO THAT {as tempting as it may seem} IS ALSO NOT LEGAL so DO NOT TRY IT.

    If they pay you again, you have the perfect 'excuse' to get in touch and point out that you appear to still have access to company email address etc ...

    That's at the same time as asking for your P45.

    Write to them (I would cc this to your area manager and to HR)
    Remind thatm that you handed in your notice on [date], that your final day was [date] and ask that they forward you your P45 and confirm in writing either that your pay as paid in March was correct or alternatively provide a calculation of final pay, including any money due for holiday as accrued but not taken. As ktay they respond and provide the P45 and other information required within 14 days.

    Get proof of posting for the letter.

    by all means copy it via e-mail ut do send it as a hard copy.

    If you do recieve any pay for April then write again, stating that you have ben paid in error and asking them to confirm the account to which the money should be re-paid, and confirmation that they will ensure that the position is corrected with HMRC to ensure that you are not incorrectly taxed.

    it may also be worth contacting HMRC directly and letting them know the position, although I don't think they can directly do anything if they are told you are still getting paid.

    Meanwhile, ensure that anything you are paid is set aside in a separate account and that you haveexplicitly said to them (in writing and keeping a copy of the letter) that you have been paid incorectly , as you are no longer an employee, and that wish to repay the money as soon as possible.

    If you have their bank details you could repay it immediately, but this may be tricky unless you can input a very clear reference - e.g. [yourname-refund]

    How is the pay done, dont they need timesheets or use a clocking in system for the paying of staff, if you havent clocked in or submitted timesheets how would you get paid ?

    Dont log into the companies website and if you do get paid phone them and return the monies to my Nigerian bank account.
