Buying Ex Partner out - without cooperation

Myself and my partner bought a flat 5 years ago. I put in all of the 10% deposit and we had a deed of trust stating that it would be spilt 60 / 40. The property has increased in value and there approx £190k equity. We agreed I would buy her out. This was going well and as the spilt was amicable I transferred approx 75% of the money because I was waiting till I was in a position to remortgage, now that time has come and my ex is delaying signing the document to transfer the ownership. She has had it for 4 months now and used various reasons for the delay.
Obviously in hindsight I shouldn't have transferred the 75% but she wanted the money and as things were civil I didn't see a problem with it. What legal frame work if any do I have to force the the BTL remortgage?
