    Just thought I would give an update on our request for CCA's.
    Out of the 6 creditors, not one has yet supplied these.
    I thought I would set out the responses so far, might help those of you who are dealing with the same companies.

    PRA Group ,Originally Barclaycard - Debt Unenforceable
    Idem Servicing Originally Halifax - Debt Unenforceable
    Lowell , Originally ASDA - Have requested CCA from Creation account on hold
    Robinson Way, Originally Tesco- Currently on hold
    NCO Resolve , Originally HSBC and our biggest debt by far, an acknowledgement letter we are going SM and nothing in response to the request at all
    Nationwide- Nothing at all

    We are currently building up an emergency fund and playing the waiting game. I will write to PRA and Idem offering 10%. If they don't accept I will wait 6 months and try again.
    So far so good, how's everyone else getting on?

    I was thinking of £1 payments for six months to get them to default quicker. What will they do if I send the I&E form but do not make any payments, will they default quicker or what else can they do ? They I&E form shows I can make higher payments and I am worried they will reject the token payments once they read the I&E.....help:eek::eek:

    Hi all,

    Wondering whether someone can give me a bit of advice what to do with the I&E statement for my credit card. I am attempting to self manage this one oooeerr. I am concerned the I&E statement will show I can pay more but I want them to default. What do i do :eek:

    It's so hard making that leap from being someone who can use credit whenever and knowing that once you take this step you can't, and its not an option for the foreseeable future. But that in itself is very freeing once you get the initial stages over and your living on a sensible budget you will feel so much better , happier and in my case, able to sleep at night.
    Our debt was almost £50,000 when we started and we are down to the low twenties. Good luck with your journey, loads of wonderful people and advice on here.:)

    The thing that gets me down the most is that for many years we managed to live a comfortable life without using any credit. In fact 2.5 years ago the only debt that I had is the mortgage! So we're no strangers to living within our means and not having access to credit.

    2.5 years ago we had some marital issues that almost resulted in a divorce. Things got very messy, I was very lonely and I started spending money on myself in an attempt to escape my problems. I applied for several credit cards and started spending lots of money on myself and the kids. Totally irresponsible I know but it made me feel better at the time and I didn't think about the consequences. After about a 18 months I had managed to accumulate about £12k of credit card debt which I was able to service with no issues. In January this year I decided to consolidate and took out a £12k loan to pay off the cards. But then my wife suggested that we use the loan to renovate the house (that was a big mistake!). So I found myself in £24k debt instead. In a desperate attempt to make things better I made the fatal mistake of getting into binary trading (euphemism for gambling) and ended losing a further £20k.

    I feel terrible about letting myself and the family down but it is what it is and I have to deal with the situation I've gotten myself into.

    I'm still playing the waiting game, hoping no news is good news;)

    You may have already told us, forgive me if so but my poor old brain is befuddled with CCA/ unenforceable debt info at the moment, and I can't remember:o.

    I'm assuming you aren't paying anything at all to your creditors whilst waiting for the correct information you requested. Did you inform your creditors that you wouldn't be paying them until they complied or did you just leave it once you'd sent off the requests? A couple of mine acknowledged that they'd received my requests and had suspended collection on the accounts for the time being. I assume that's until they 'find' what I asked for(if they ever do;)) so I feel OK about not paying them at the moment. It's the others I'm worried about, those that haven't said they have suspended collection or haven't even acknowledged that they are trying to find the info that I asked for.
    Do you know if there's a template letter anywhere detailing the legal explanation for not paying when awaiting CCA stuff to come?

    Hi Carbootcrazy No we are not paying anything at the moment. Most are on hold other than the ones who haven't responded at all, namely NCO and Nationwide but all have cashed the cheques so they must be aware of the original request.
    I think when we get back from a few days away we are going to give those two a call and find out what's happening.
    I'm almost sure there is a follow up letter on the NEDCAB website when they haven't complied with a request.
    I am honestly amazed how poor these companies are. I know those more experienced are not suprised at all but I'm shocked that not one of the six can produce the requested info:eek:

    Good Morning, Zenboor.


    One of the very first things you need to do is set up a 'clean' bank account with a bank that you have no debts with. This is to have your salary etc paid into and for your DDs to go out of. Lots of financial institutions are involved with each other in some way so make sure your new account is not under another one's 'umbrella' so to speak. Once on a DMP you will only qualify for a Basic account. A lot of us have the Nationwide FlexBasic account, it's very good and does everything I need it to do (without an overdraft, obviously, and with no chequebook but they are of no interest to me anymore). Maybe, pre-DMP you can still get a 'normal' account but I'm sure I've seen people advise not to use the switching procedure, but enter account details yourself. I expect someone will advise more on this. The bit below is taken fron the National Debtline website which I recommend your looking at for the wealth of onformation about debt and the various options for repaying it.

    Thanks for this. I already have a Santander Current Account (with no overdraft facility) that I haven't used in a while. I think I will get my salary transferred to this account from next month then setup all my priority direct debits to come out from there too.

    I agree about the companies. Totally inept:eek:. All good for us though, if the debts turn out to be unenforceable eh?;)

    Hi Julie,

    Can I ask how old your unenforceable debts are? I'm trying to work out if it's worth sending CCA requests to all of our (20:eek:) creditors or just some of the older ones.
    Fingers crossed the rest of yours turn out to be unenforceable too :T

    Hi,

    For future reference, most template letters you will ever need are available from the National Debtline website.

    There is no specific letter to ask for default dates to be re-set.

    This is the standard complaints letter, which you fill in the details yourself, tell them the nature of your complaint, and what you want them to do to resolve the matter :
