If it was defaulted the information should be recorded against the debt, regardless of who now owns/manages it, e.g. one of our debts was defaulted by the original creditor in August 2015 but not passed to a debt collection agency (DCA) until October 2016. The only entry on our credit file is under the DCA name but the default still shows as August 2015.
Does this make sense?
Jan, I just got missed phone calls from PRA Group they left a voicemail saying it was in relation to the "complaint" I made. I assume this was the letter I sent regarding the incorrect recording of the default date. PRA group haven't defaulted me on either of my accounts and have marked them as AR since taking on the DMP. I don't know if the original creditors Barclaycard and Egg put the default on as I can't find them on my credit file...only PRA Group and this might sound silly but I don't know if they sold the debt to PRA Group of if PRA is managing on their behalf?
I am assuming PRA are going to say that they can't default me as I've always been making the arranged payment till date. I don't want to talk to them as I feel they'll try and confuse me and make out they are right. What should I do and how do I find out if I was ever defaulted by Barclaycard and Egg. I've tried searching on Noodle and Clearscore but nothing...
Thank you!0 -
Debby,
If you want to sell your ipad quickly, try one of the recycling sites, i cant name them for fear of been accused of advertising for them.

Hoist are a massive debt purchasing organisation.
Robinson way do not purchase debts.
Its likely your account was bought by Hoist, and Robinson way are managing it on their behalf.
Do you have any letters from them ?
if so they should confirm what i have said.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. The letter from Barclaycard says 'the above account was assigned and transferred by Barclaycard to Hoist' .... 'the new owners of the above account are now Hoist'. So assume that means Hoist have bought it?DMP Started June 20160

It also states 'Hoist has appointed Robinson Way as their servicing agent to manage your account on their behalf'.DMP Started June 20160

Thanks Sourcrates just wanted to be 100% sure.
I keep hearing people talk (not on this site) about the three letter process when a debt gets bought. Does anyone know what this is all about? Thanks!DMP Started June 20160 -

Forget it, its absolute rubbish, already tried, and thrown out of court.
It all revolves around the original contract been with the original creditor, and the new creditor been able to prove the debt is valid, all this foremen of the land nonsense does not stand up to scrutiny.
There are no easy get out clauses, the creditor either proves the debt is valid by providing evidence, or they dont, when a debt is sold, all rights and privileges are transferred to the new owner, as allowed under the consumer credit act, all legal and above board.......
The 3 letter process is rubbish.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Why not try put the ipad on gumtree debby? You don't have to pay fees and generally you get a buyer willing to pick it up from you and get cash straight away.
Just an idea as obviously a PDL is the last resort. And you would be surprised what you can sell on there - maybe have a look around and see what you might be able to do without. Kitchen gadgets, furniture, books, CDs, comics (I made £50 selling a load of old comics my partner had stored away that he'd forgot about!).
As everyone else has said - don't even think about paying your non-priority debts until you have yourself sorted out.
Thanks hadn't thought of gumtree. We don't have much left to sell in the house really. We didn't have much to start with lol. But we continue to go through the house looking.
Our debts have already been paid for the month. We are up to date with them all. We haven't defaulted on any...that's we have no money left for ourselves. XDEBBY :j0
