Hi Sourcrates, January and anyone else....
I wrote off to my creditors asking for copies of CCA's and today I heard back PRA Group who took on my Egg/Barclaycard account. They confirmed that due to the age of the account they cannot provide copies of the original agreement and the debt is unenforceable.
Based on this I need to decide what to do. My DMP is currently with Stepchange and I've just completed my yearly review. Can I go back to PRA Group and say to them as the debt is unenforceable I'd like to offer a F&F amount? Do you think this would work in my favour? The amount I owe is £1,680.99 so what would be a good starting point? Would I make the offer to Barclaycard or to PRA Group? Any other pointers?

You can just walk away and pay nothing.

You simply remove it from your DMP.
That's all you need to do, or offer them 10p.
Without a valid credit agreement the debt is unenforceable in court, therefore the creditor cannot obtain judgement against you.

When I started mine I requested a repayment holiday on our loans from the bank which they agreed to. This saved us a bit and then I explained to SC that my car tax and insurance was due so I held off my payment for a month. The advice on here is to usually hold off payments for a few months and save this as an emergency fund.
