    A SAR can take up to 40 days.

    Sorry, I meant CCA request for a copy of the original agreements :)

    So I should wait another few weeks before doing anything....so they still have time to provide the agreements then :(. That's annoying!

    So if it!!!8217;s just a 14 day response guideline presumably they can take all the time they like to respond and there!!!8217;s nothing that can be done about it??
  • Hi All,
    I have been lurking this forum for quite a few months, reading diaries and trying to find out as much info as possible, everyone is so helpful but I'm still in the learning/ teething stages.
    We are now in a DMP, set up in Nov and started in Jan with Stepchange, all is going well....we will eventually go self managed, but probably later in the year, as not ready to take that step yet.
    We have a huge debt of 70k, so our plan will be to use some of our pensions that we are able to use when we reach 55 ( in about 4 years) to clear some of it.
    Anyway as we are new to DMP, none of our Debts have been sold on as yet...So do we CCA this early on in DMP or wait ? We have 5 Debts in total.... ( 4 x Credit Cards and Next Account.....I think all before 2007)
    Any advice appreciated

    Hi and welcome,

    You can do the cca's now, the only issue you may have is with stopping the payments whilst they are on hold or if they are UE if you are with SC. This was one of the main reasons I went SM.

    That is correct, but you don't need to be paying them until they produce the goods, its all swings and roundabouts..!

    From my experience most who can produce them take a few months, and those that can't.. well that's a whole different ball game..

    I wasnt looking at stopping paying but I was thinking it would be easier to CCA before they got sold on ? We are still so new in the game and would be too scared to stop paying, but it would be nice to know if UE for future settlements in about 4 years maybe xx

    Why on earth would you keep paying them for 4 years if they prove to be UE :huh::huh::huh::huh:

    Theoretically that's true, but until they do respond to you, that account remains unenforceable in court.

    You have to remember that creditors will hold millions of credit agreements, lots of which will be in paper form, all filed away in a room some were, and its most likely one persons job to chase these up, lots will also just exist in digital format, so the whole process just takes a lot of time.

    What is it you think they could do to you. that makes you so scared ?

    As regards settlements, it would not make much difference to be honest, the creditor would still hold out for a big payday because the very fact your asking means you will eventually pay them what they ask in order to settle, even though you could walk away and pay nothing.

  • I suppose because we have been struggling for about 6 years, literally robbing Peter to pay Paul to pay the credit cards back each month, and cannot believe how easy the DMP is turning out to be , I suppose it's silly but we are scared of upsetting them.... It took alot to phone stepchange in Oct, but I so wished we had done it years ago. I know the Credit Cards have had so much interest off us...... before we did a DMP they were quite rude on the phone when we were a few days late making a payment ( that's what made me call SC)....but when I phoned them this week to query why they were still charging me interest on my credit card and not my husbands, even though we both started DMP together at the same time, they couldnt be nicer and apologised and refunded the interest !
