can they recover a 7 year old debt

hi their can anyone help me:confused:
i have just recieve a letter off a debt recovery agency asking me to pay a debt that my husband caused 7 years age with a catalogue in my name:mad: ,it is for £454.i phoned the debt agency and explained the situation and the instantly made an offer that would save me £136 if i paid in full that day.my now boyfriend says not to pay as the debt is over 5 years old is he right and should i forget this debt.hope someone can help i'm starting to worry that it will give me a bad credit rating or even blacklist me.

    If the debt is in your husbands name and he is no longer with you, I Would agree that this is not your responsibility.
    I am a former Broker, former IFA and former compliance officer, for my sins.

    However, I have since seen the light.

    So it's in the OP's name.

    I think that statute barred means a debt will be *cancelled* after 6 years of zero contact. I may be wrong.

    sorry missed that. Yep If you have had no contact in over 6 years the debt is statute barred.

  • Are you divorced Heather? If so and the debt is in your exes name then forget about it as its not your problem. Even if you're not I alsothought it was 6 years & then the debt was written off. Have you not had any other letters from them in the past 7 years?

    the debt is in my name but what i realy want to know is,is the fack that the debt is ovr 7 year old have they got a right to claim it back

    An ordinary commercial debt is dead after 6 years of no action BUT beware of the possibility of getting into negotiation during the 6 years as this acknowledgement could start the the 6 year clock all over again.
    Just refuse to speak to them.l

    The 'phone-in "help" desk industry had been born.
