    Stop worrying about something that might not happen. It's 1 week.

    Re probation it's established in case law that you're deemed to have passed if you haven't been told otherwise. Not that it makes any difference in this instance, your notice period is the same.

    They could say that but you could ignore them. Your contract says one weeks notice (until you complete your second year of service) on both sides.

    Received a job offer today, which I will accept.

    They would like me to start early May.

    When would I hand my notice in, bearing in mind it's one week's notice?

    If I were to hand it in this week, there is potential for me to be without pay for a good 7 weeks.

    Or do I hand it in, 1 week before I'm due to start at the new employers?

    It goes without saying nothing is being handed in until the contract is received and signed!

    Would be interesting to know what advise people have!

    1. Work out what holiday, if any, you are owed (or what you owe them.) If you are due more than a week's holiday, this may affect when you hand in your notice. Do you want to TAKE your holiday before your new job, or be paid for it?

    2. You don't sound especially friendly to your employer. If you had an excellent relationship with them and trusted them not to terminate you early, you might want to tip them off now that you will be leaving in early May, so that they can arrange for you to do a handover. If you don't trust them, obviously give them one week's notice.

    How on earth do you work this out? It's now early April. I don't see how it could possibly be more than 5 weeks (or four weeks, once you gave a week's notice) until early May.

    How do I calculate holidays?

    I have 28 days inc. bank holidays. which runs to 1/1/17-31/12/17.

    I've obviously worked 3 months so thats 1/4 of the year, so is it as simple as 1/4 of the 28 days, which is 7 days holiday?

    Yes, except you accrue holidays up till your finish date, so if you handed in your notice to end on 30 April, you would have accrued 4/12 * 28 days = 9.33 days (days can be rounded up, but not down, so they might call it 9.5 or 10, but can't call it 9)


    Then you would deduct any you've taken this year. Have you/will you have any days off? I'm guessing from the wording you've given, that you won't be working on Good Friday or Easter Monday, and that you didn't work on 2nd Jan? If so that's 3 days deducted.

    So far, I've had 2nd & 3rd Jan as a Bank Hol & office shut down. And I've used 4 days since then. So at the moment it's a total of 6 days holiday I've used since 1st Jan.

    As it comes across you're scared of handing your notice in. Or at least don't want...I'll give you an option. You have 3.5 days left as holiday, if above info you provide is correct. Your notice is 7 days. There is an option, however un-favorably this is looked upon by others, of just leaving and not bother going back. The worst that could happen is that you'll get sued for 3.5 days worth of your wage. Even then, that's rare in practice. In my experience. It may backfire if you need a reference.

    At my last place I figured out what holiday I was owed. Booked them off at the end of the period I would technically be employed by them and then handed in my notice a few weeks later.

    Had the last x days off of the 4 week period. Was epic - but I wanted a break between roles. It gave me a chance to do all of my ironing and have a relax.

    Personally with one weeks notice I really would give it to them and suck up the having to work the week. You may need them for a reference at some point. It may not be fun or ideal - but it is only one week.

    Agree with the handing notice in one week before you're due to leave. If you're in doubt, that is.

    Even if you don't plan to leave until early May if you don't have a good relationship with them they could make your last few weeks difficult if you say you're leaving now.

    Realistically they probably won't take you to court if you don't give notice, but as above you may need a reference in future, so best to part on good terms.
