    Legally, yes they could. Whether they will do so in practice, is something that only your employer can answer.

    David, I am guessing that you work somewhere like a University as they often say you have to give 3 months' notice, however, if you go to your current employer and say that you have accepted a new post that you are required to start in 4 weeks' time, they should see sense and let you leave early because it will be obvious that you won't give the job your all whilst you are ticking off the days until you start your new one.

    Alternatively he could be in a job with highly specialised skills, where it would take more time than usual to recruit an equally skilled person.

    The type of job really is not the issue. It is whether the employer will assert their legal right to claim against the OP for breach of contract.
