Separated - transferring mortage and house into sole name

Hi
I'm not sure where best to put this.
I am mid divorce proceedings - decree nici due soon.
I have a mortgage offer that will expire before we are able to sort a consent order and decree absolute.
Is there any reason why we can't transfer the house and mortgage in to my name now to save losing this offer (and to get a job out of the way).
The final consent order will involve me keeping the house, with him taking more cash and a house he has bought since we separated.
Are there any capital gains implications?
I realize nothing concrete can be gained on here, but it's a while before I can see a solicitor again and time is running out on the mortgage offer.
