Hi,
Can my current employer see via my tax code or any other means that I have a second job? Contract says I need to get permission. I am not that happy to ask for permission to do other work in my free time!
So intend to keep my mouth closed to everybody and reap the awards of doing extra work. Signed that opt out for more than 48hrs.

Your second job will be taxed on Basic Rate so your main employer shouldn't be able to tell.
It would only be if you contacted HMRC to split your tax code that your employer may notice something but would they really question it?0 -
My main job is more than the personal allowance so it would be pointless asking the HMRC to split. The second job is only amounting to under one thousand a month. Probably not even near that.0

And if they get wind of you doing the 2nd job then you're potential up the creek.0

If you weren't happy with the terms of the contract then why did you agree to them? I'd be upfront, rather than worry about them finding out somehow.0

Have you discussed this with your carer, and the DWP?
The reason for the clause in your contract is that the employer has a duty of care towards you. If they don't know that you're working elsewhere and you have an accident due to overwork then they're not going to be liable. The same with not declaring your disability, they cannot support you if you become unwell and they're not aware of it.

If your proposed second job doesn't conflict with your main job, either by potentially taking work away or making you so tired you don't do you main job properly, they are unlikely to object. So what is the problem with asking?
Contractual term or not you owe your employer a duty to act in good faith and in the best interests of their business.
By directly breaching a specific contractual term you are potentially committing gross misconduct and are handing them a free and easy way of dismissing you should they want to.0 -
Not telling them is a breach of trust.0
