Still on Ex's mortgage

I need advice from you lovely people, currently me and the other half have been renting for a couple of years. We need to buy somewhere bigger as the step-kids need their own space at weekends.
Hubster divorced about 4 years ago and agreed to give the ex everything, including the house. He signed paperwork for the bank to take his name off the mortgage and thought that was the end of it. We have now found out that his ex did not remove his name from land registry or the mortgage as she said she would. We have spoken to her (as we are on good terms) about the situation and that it is stopping us getting a place together. She has put her foot down and said she will not remove his name as she doesn't want to pay the fees involved and get tied into a fixed mortgage, claiming she wants to move in the near future.

I have Googled this and found old threads from 6+ years ago so would really appreciate up to date advice.
1) Is there are way we can get his name off the mortgage, he feels that he has been "duped" into this situation
2) If she fails to pay the mortgage or something happens to the house, will he be liable for payments?
Anyone been through something similar and can offer words of wisdom??:wall:

    One assumes that legal advice was sought at the time. The outcome being a negotiated settlement. Are there still children living with the ex?
  • During the divorce they had legal advice and he made it clear that he only wanted out of the marriage, he was handing over the property to her. There are 2 children involved. They stay with her and her new partner Mon-Fri and us at the weekends.
