Didn't you get a financial settlement when you divorced? What would happen to the house should have been sorted out during those discussions.

We have an arrangement in place, made via an agreement by email. Trouble is, its vastly changed as she now has someone living there.

Originally we had the house up for sale. It sold for full asking, leaving us around £50k in equity each. The plan was to simply split the proceeds. Then she pulled it from sale, as she realised it would be harder to pay rent than a cheap mortgage.
We made the agreement then that the house was valued at that price and as she had moved her partner in I would no longer pay toward mortgage and my equity was set. She then agreed to try to pay my equity or at least some of it within 2 years.

Fast forward a couple of years, had no equity and no likelihood of getting it soon. I feel I will need to wait until kids are 18.. but in the meantime the house is getting run down.

Whilst we do have it in writing that I will receive my equity valued at the time we split, she has since offered lower amounts (Not that she could afford that anyway!).

I took virtually nothing, lived with parents until a year ago when I met someone and we decided for both give living together a try

I have heard I could get a charge on the house, but without much to cover solicitor its hard to know where I stand

    Thanks for advice btw!
