Equitable Charge Question

Hi
We bought our house in 2004, and have since re-mortgaged twice, the latest being this year.
The solicitors have advised that an equitable charge was registered on the property in 2000, and that the previous solicitors used should remove it.
I've sent them a mail, and left a message on their desk (as they no longer do conveyancing)
My first question is why are mortgage companies not checking the charges before lending the money, some seem to bother some don't? But also, I assume the original company would be obliged to make the change at the registry?
