Notice period unfair?

Hi,

I recently handed my notice in. My contract states it was to be 1 month for the first 4 years of service and then rising to 3 months thereafter.

My CEO is unwilling to reduce it and I have (begrudgingly) accepted it.

I am in a senior position here - however, my immediate manager is of more seniority and I just found out that his own notice period is only 8 weeks.

It is very annoying that I as a less senior person have to do a longer notice period than someone of more seniority. I respect that they joined before me and were given a different contract but it just seems unfair.

With this new information on the disparity, is there anything I can do to reduce my own notice period or just suck it up?

    Other than asking nicely unfortunately no you would just have to suck it up.

    Or breach your contract, which isn't advisable.

    You have said your CEO is unwilling to accept a shorter notice period so there really is very little you can do other than walk out and accept the potential consequences.
    The notice period others have to serve has nothing to do with what is set out in your contract. The other person may have negotiated their notice period either when they started or at some other date in the past.

    It may be annoying but it is not unlawful. Perhaps his services were more desirable so he was in a better position to negotiate a more favourable contract?

    Anyway, as other have said, you are basically stuck with it I'm afraid.

    It is a popular misconception that all employees must be treated the same. It is perfectly lawful to discriminate unless it is for one of the few reasons protected by law (race gender etc).
  • Don't burn your bridges, just wait it out and leave on good terms.
