Hi all
I have received a PNC from UKPC. The reason given was "Not parked correctly within the markings of the bay or space." I was however not parked in a space and had accidentally parked on the road. Am I right in thinking that as where I was parked, there are no road markings, either for a parking bay or road, it is impossible for them to enforce the ticket as they cannot prove I was incorrectly parked in a bay.
Thanks

Today is day 26. I sent this
Date
Dear Sirs
Re: PCN No. ....................
I challenge this 'PCN' as keeper of the car.
I believe that the vehicle was adequately parked and therefore you have no right to enforce the fine. Based on your photo’s, there is no evidence the vehicle was parked straying over any markings of the bay.
Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
Should you obtain the registered keeper's data from the DVLA without reasonable cause please take this as formal notice that I reserve the right to sue your company and the landowner/principal in your contract, for a sum not less than £250 for any Data Protection Act breach.
For the avoidance of doubt, I do not give you consent to process data from the DVLA relating to this vehicle, whether you have already obtained it or not.
I have kept proof of submission of this appeal and look forward to your reply.
Yours faithfully,0 -
Like what actually happened really matters to a PPC...!
Stick to the Newbies Sticky - that does work.

I received a reply to my appeal.Thank you for your recent correspondence in relation to the above parking charge.
In order to make a final decision regarding your appeal, please can you provide the full name and address of the driver to our appeals Department within 14 days of the date of this letter.
The letter then goes on about POFA 2012, providing evidence and the contract entered into when going in the car park. It ends...Failure to provide this information will give us no alternative other than to make our final decision based on the previous information received, at this stage a POPLA verification code will be provided.
So I take it this is just a ruse to get the drivers details as people will hope the ticket is cancelled if they do it.
What is the best way to respond to this?0 -
UKPC still spouting that rubbish
UKPC don't know who the driver is ...... it can stay like that
Such a stupid company. Very difficult to respond to rubbish0 -

I was thinking of reply stating that I would charge £90 to respond to the inquiry. With a £10 admin fee as well of course. 0

I did the same last night, I went to a a "FREE AFTER 6.30 " Car park , It was full at the time " 7.30 " so i parked tight along the fence, where a few other cars were parked, Not on a double yellow, not in a space, Not blocking the traffic, So Wow how mad was i on return, as how Free, is Free ? Plus the ticket time was wrong issue time 15.43 when it was 7pm + Does that simple mistake invalidate the ticket, or both details ?
Help offence listed was not parked correctly within the markings of the bay space ,0 -
