Mortgage Redemption Statement Problems

Hi Guys - I have a little problem I thought you might be able to help me with.
My stupid solicitor has paid my mortgage company too much due to them sending a obviously incorrect redemption statement.
He claims that he does not have a obligation to check the figures at all - so I have to deal with the mortgage company myself. Is this right?
Also what is the procedure for reclaiming the overpayment?
Any help would be appreciated - I am pulling my hair out here

Im afraid I dont have the answer as to whether the solicitor is ultimately responsible, but you could approach the Law Society, the legal services ombudsman. Im sure they will be best placed to advise you on this point.I am a Mortgage AdviserYou should note that this site doesn't check my status as a Mortgage Adviser, so you need to take my word for it. So, your solicitor received, in writing, the redemption figure and paid that and you think the solicitor is stupid? He claims that he does not have a obligation to check the figures at all - so I have to deal with the mortgage company myself. Is this right?
It isnt his error and he acted in accordance with the documentation issued. Also what is the procedure for reclaiming the overpayment?

He received the documentation from the lender which stated he must check the figures himself and with me first before releasing funds which he didn't. He didn't even call me to give the figure he was given. So I would say he didn't act in accordance with the documentation and common sense.Mortgagehero wrote:Im afraid I dont have the answer as to whether the solicitor is ultimately responsible, but you could approach the Law Society, the legal services ombudsman. If it says that, then he should have done so. He would keep a copy of that document on file (as would the lender). Yep, he gave me the copy of the statement which was sent by the lenders solicitors which stated this.
Anyway have drawn up a letter with what I think the figure should be to send to the lender. I am seriously considering putting in a complaint against the solicitor though - he really is useless.I always tell the truth. Even when I lie.0
