Hi guys, need some advice. I have an outstanding debt of roughly £2k with Idem, the debt has ended with them after been passed along (I can't actually remember where it originated!) from 2010 to 2015 I was in a debt management programme until i realised I was paying Harrington Brooks more than what was being paid off my debts, Aiden were getting a very small amount each month, so I ditched HB and dealt with all my creditors directly, Idem wanted to know the ins and outs of my personal finances and look at income and expenditure but I refused on the basis it was nothing to do with them, I offered a monthly payment of way more than what they were getting and they eventually accepted, it was originally for a year but they took payments for nearly 2 years. Last July it finished and I have since been bombarded with letters and phone calls trying to set up a payment plan, which I gladly said no problem, but again they insisted I do a full income and expenditure check with them apparently to "check I can afford to pay it every month". Again I have point blank refused on the basis I wouldn't be offering if I couldn't afford it. I have said if they accept the offer right now I will set it up without fail but they just will not accept! I am now getting letters threatening further legal action because they have not been able to contact me and reach a solution!!!! I am fuming! What can you advise???

Actually they are just complying with CONC 7.3 Treatment of customers in default or arrears.

Affordability is the key word these days, they must comply with the legislation to make sure you can afford the payments you are offering.

Sourcrates is right. If Idem have bought your debt they have the same rights and obligations as the original lender. Ultimately it’s up to you whether you supply the requested information. Bear in mind they could potentially start court proceedings though.
I would suggest making your proposed payments anyway to show good will. They may just decide to accept them if they’re getting paid.
