Is it possible to check child benefit claim?

  • I guess everyone is trying to be helpful, but I have only had unsolicited comment on the explanatory areas of my post which were not relevant to my query, but posted purely to explain my reason for my question. I only have one question, and that is the header for the thread. I think I can assume that the answer is 'no', which i assumed it would be as I googled for a long time before coming here to ask for help. I don't mean to sound ungrateful, but sometimes people are just looking for an answer to a question, not opinion on how they conduct their lives :(
  • This happened to my husband he has 2 children with ex wife she claimed child support for the 18year old and he didn't attend college and now his daughter in college so she won't put him on contact so he can't get her attendance but does regular spot checks, also wrote to child benefit about the son not attending and they did write back saying they would do their checks also write to tax credits etc and did online benefit fraud. The new cams also ring the pwc every mm the and she has to repeat a legal statement and tell her it's recorded and if she lies then she is liable to pay any money back. Unfortunately with the son we were paying on the old system and we are told we won't get any money back! Goodluck it's a hard one
  • Is it possible for you to obtain information from HMRC directly about someone else's Child Benefit claim - No. You have no legal entitlement to that information from them, so Data Protection rules will prevent them sharing it with you.

Is it possible for you to ask CMS/CSA to check if your daughter remains eligible for child maintenance? Yes. Absolutely. Whether or not they will agree to your request is another thing - as others have suggested it will likely depend how you frame the question. A speculative request is likely to be refused.

    To illustrate the point further:
Can your ex get details of your income directly from HMRC? No. She has no legal entitlement to that information from them, so Data Protection rules will prevent them sharing it with her.

Is it possible for your ex to ask CMS/CSA to check if your income has changed? Yes. Absolutely. Whether or not they will agree to her request is another thing - it will likely depend how she frames the question. A speculative request is likely to be refused.
I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. Hopefully you'll still know what I mean.
  • You also find it's the pwc on benefits that lie that is what happened in our situation.

"Ask CSA/CMS for a CoC review as child is no longer in FT non advanced education and no longer living with PWC"

    THIS

Another option is simply to stop paying until they prove that you have too. Save the money in a separate account just in case. If your DD doesn't live with your ex then she will be registered as living somewhere else. Why on earth don't you have contact with an adult child who doesn't live with their parent? Or is it her choice not to have any contact.

    PLUS

People have taken time out of their lives to respond to you on this thread so a little bit of gratitude could be shown, instead of moaning that no-one actually answered your question.

    AND

What on earth have your ex's affairs got to do with the money you need to pay?
Overactively underachieving for almost half a century

I answered your question based on many years of experience with the CSA and offered no opinion!

    Your gratitude is overwhelming!
  • I'm sorry that you didn't find the answers helpful, I genuinely tried to answer your question. As I have found to my cost in the past if you give a lot of information people will lose or misunderstand your question. Good luck to you, don't let the unfair criticism bother you.
