Statutory Demand, Connaught??

Hello, I have received a letter at my address from Connaught collections. The letter is in my partners name and is for £8600, basically it says if he doesnt pay up within seven days they are issuing a statutory demand. My partner is not living at this address at the moment, he is living in Norway for at least the next 6 months.

What does this mean? will they just make him bankrupt, we have a house together in joint names with a total equity of only £10000.

Does the demand have to be delivered to him personally? Obviously i am still getting some post from him as he is just working away or can they go ahead with proceedings without ever seeing him?

    Connaught Collections seem to be 'fixated' with the concept of using the word 'statutory demand' as a threat.
    If your partner is living outside of the country, simply return the letter with the words 'not living at this address' written over the envelope.
    You are not under any obligation to give a forwarding address - or even to forward these letters yourself.
    Whilst Connaught could petition for your partner's bankruptcy - they would need, first to be able to 'prove' the debt, and secondly they would need to prove that they 'served' the statutory demand.
    I would be inclined to think it's a 'threat' but I would suggest that you have a word with CAB.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • I had one of these a couple of months ago. Thanks to the very kind advice on here (thanks again Rog2!) I sent them a letter demanding that they provide me with the signed CCA. Four days later I had a letter from Connaught telling me that they would not be chasing me for the debt after all...

    They're a bunch of chancers. Follow Rog2's advice, and when your partner gets home if they're still hassling you tell him to demand the CCA.

    Hi, thanks for your quick response. I read about asking for the cca, spoke to my partner about it and he said that they had already sent that a while ago so they do have the agreement and the debt is my boyfriends. he cant afford to pay it.

    I have never ever of Connaught going ahead with a bankruptcy petition after one of their so called 'Statutory Demands'.

    But as already said, it is most likely a scare tactic.

    Should a SD (or something that claims to be one) be served or come in the post I would:

    a) Check back here with us. :)
    b) Talk ASAP with one of the organisations in my signature. National Debtline are quite clued up on this I think.
