Corp Card Charges

Hi all,

This is the situation:

I was working for my previous company but they failed to pay my expenses that I put on my Corporate Charge card (American Express). I have tried to get these monies back to no avail. That’s not what I am asking here.

Because I am the liable person for this card and not my last company I have to pay £5000 to Amex who passed me on to a debt collection agency RMA despite my request for time to pursue my last company for this debt. As such they have charged me £68 as charges for non payment since July 07. So that’s £204 in total.

I have now got a loan to pay the bill but I asked RMA to refund the £204 as I don’t see this as part of my debts. I said that with people reclaiming bank/credit card charges why can’t I claim back the £204?

RMA claim that for charge cards the law is different and as they don’t charge interest that they are allowed to charge this. I am about to send a cheque off for the total amount to get rid of them but I do so with grievance.

So need some advice of what to do:

Do they have the law right?
Should I send them the full amount?
Any other options available?

    I'm sorry but I am not sure of this at all - perhaps you could ask over ont he credit card board - they might have more knowledge about this? :)

    As far as I understand it, it is punative charges that are unlawful (and surely a charge for late payment is a punative charge?), so I'm not sure why this wouldn't apply to charge cards too....but I could be wrong - does anyone else know?

  • I have the same problem, but I owe £12,000 on my corporate AMEX. The debt has been passed to RMA who are being very aggressive with me. As I lost my job I could not repay this debt and my company say I am personally liable.
    I have a lot of debts and am now on a plan with the CCCS.

    RMA have told me that they will not deal with the CCCS as this is a corporate charge card.

    I am very upset and dont know where to turn.

    Why dont you pay it and then issue action via the small claims court against your prev company?
