Hi Everyone
Apologies if this has been posted in the wrong Sub-Category.
RBS have recently closed my account citing business reasons. I'm over £1000 over my overdraft limit which is £1000 so I owe RBS pretty much £2000.
The reason for this is a had what I thought two genuine claims for Direct Debit refunds from a company totaling just over £1000. I got the money back from RBS, spent it on clearing some other debt only for one of the DD refund to be rejected putting me over my overdraft.
I was disappointed but accepted the decision and worked out a payment with RBS. A week later the other DD refund was reject, RBS took the money back and then said because I had broken the payment plan they were defaulting me and closing my account withing 60 days.
I can accept the DD refunds being rejected and paying the money back and also accept them closing my account but the default is extremely harsh I feel. I was never warned about this, I never got a letter explaining this would happen.
Do I have a good chance of getting the default removed if I complain?
Thanks for any advice.

Hi ml1973,
Bear in mind there are 2 types of default - the one on your credit file and the one that the lender must send before they can start any potential court action.
If they are suggesting that they will record a default on your credit file, then I am afraid it is very unlikely you will get the default removed. Only incorrect information can be removed and this wouldn't be incorrect. Overdrafts are payable on demand and failure to do that means the agreement has defaulted, so they can do what they have said.
Make sure you open a new basic account with a new bank (I would suggest you stay away from NatWest as they are linked to RBS) and then start a new repayment plan with the overdraft. Good luck,
Laura
