Hi me is new here and I have to get my two peneth in about crapquest
Ive been contacted by them for a halifax loan I defaulted on now I know this is outstanding and needs to be paid. I am in a fortunate possition to pay this in a few weeks and when they contacted me I told them this.
Instead of noting the file duly and holding this they demanded to know my whole life history down to my show size and whether I pick my nose in public (sorry could resist that) they demanded to know where the money was coming from who my solicitor was thier details etc which i refused . only for my call to be taken by a "manager" who was the most obnoxious scottish banker I have ever spoken to he referred to me as a liar accusing me of not wanting to pay my debt (if I didnt the why the hell did I tell em I would derrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrr) and tried to force me to pay a holding charge there and then which i declined with that he said that I would get courtesy calls everyday until it was paid funnily enough the phone was silent today :rotfl:
The most amusing thing is that I used to work as collector for a firm and left after just a few days because of the tactics we were told to use. Some of the collectors were even joking and saying that all people in debt were scum and not worthy of anything

im in dealing with them at the moment i am getting calls from capquest aswell as jb too... they can not call you everyday thats harrassment...
someone will be along shortly that can help... these boards are wonderfull..0 -
Hiya, I can understand it's frustrating - I suppose looking at it from their point of view, if you have defaulted on the loan, they may not want to just take it on trust that you are going to pay it soon, and will want to know exactly how, when, why etc (not making any judgement here, just suggesting a possible explanation for their reaction).
Just hang in there until you can pay it, and then you wont ever have to deal with them again - if they DO start calling you every day, you CAN send them a letter asking them only to contact you in writing.

Here's a template you can use to ask them to stop ringing, just in case you need it:
Dear Sir/Madam
I am writing to express my serious concerns regarding the telephone calls that I have received from your company.
I am now formally requesting that all further correspondence be made in writing only.
I demand that these phone calls stop immediately. I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts.
If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
You will be deemed to have been served notice of my request and I will deem it served by (FULL DATE), I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.
