The advice to ignore private parking tickets has not been given here since the law changed in 2012.

Who sent the Legal Action Recovery letter please? If it was from a debt collector, that can be ignored. The NEWBIES thread explains why it is safe to do so.

Please also tell us the date of the alleged event, whether there was a windscreen ticket/PCN, and what date the notice to keeper/NTK was received.

    edit,

Just checked and DCBL are Direct Collection Bailiffs Services, debt collectors, so the letter can be ignored.

if its DCBL acting as a debt collector (DCA) it can be ignored as mentioned in the debt colelctor part of the NEWBIES sticky thread

if they (the PPC and therefore DCBL) have an outstanding CCJ against you (a court order) , then no it cannot be ignored

in any case, you should have complained to tesco and got it cancelled

what country is this in ?
  • Hi,
    Thanks for the replies.

Yes i did complain to Tesco but was told that they did not own the land.

Below is a copy and paste of the text.

You have failed to pay DCBL ( Direct Collections Bailiffs Limited ) the outstanding balance of £ 160.00 or make contact to discuss the repayment of this debt. We have now recommended to our client the commencement of legal action against you. However the granting of judgements and other orders are at the discretion of the courts. If successful the escalation of legal proceedings at a cost of £ 75.00 would be added to the debt for recovery. After further applications have been granted by the court the possible impacts of having a cci registered against you would be:

Enables enforcement action to commence, such as obtaining an Attachment of Earnings, placing a Charge on your property or applying for a Warrant of Control to remove goods.

    Prevent future lending

Thanks in advance for your replies / advice
  • ok , lets try ripping that statement apart

You have failed to pay DCBL ( Direct Collections Bailiffs Limited CORRECT

) the outstanding balance of £ 160.00 NO ITS NOT the figure on the signage stated £100
or make contact to discuss the repayment of this debt. We have now recommended to our client the commencement of legal action against you. WHY , because you have failed?

However the granting of judgements and other orders are at the discretion of the courts. CORRECT , but only of you loose and refuse to pay

If successful the escalation of legal proceedings at a cost of £ 75.00 would be added to the debt for recovery. TRY IT

After further applications have been granted by the court the possible impacts of having a cci registered against you would be:SEE reply 2 above

Enables enforcement action to commence, such as obtaining an Attachment of Earnings, placing a Charge on your property or applying for a Warrant of Control to remove goods. see reply 3 above

Prevent future lending yawn , ONLY if a CCJ is obtained

    England or Scotland?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • My guess is that this was somewhere in the north east of England, probably Teesside - Smoggy will confirm.

Northern Parking Services' website claims that the term "don't pay private parking tickets" no longer exists. A very strange claim to make - I'm not aware that this term has been deleted from existence.
  • Hi,

Correct assumptions...Area alleged offence took place was in the Uk and was on Teesside.

Thanks again for the assistance it's much appreciated.

Is it absolutely clear that DCBL are acting for NPS? Could it be that MIL Collections Ltd are involved here somewhere?

If DCBL are acting for NPS then they will say so. Similarly if they are acting on behalf of MIL they will identify MIL as their client.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
