Old debts

Hi, my friend had been paying Harrington Brooks (I know) but has now stopped. She has logged onto clear score but there's no debts showing any longer.

She is waiting for DCA's to get in touch. My guess is that the debts have been passed about that many times that they probably won't have any paperwork concerning the original debts.

Whats her next step when she starts getting letters?

    Hi,

    If shes been paying the debts, then the question of statute barred docent arise.

    A standard response to any new request for payment from a DCA would be the "provit" letter, available from the stickies at the top of the forum.

    Then its a game of wait and see what they come back to her with.

    If they can provide proof, that the debt is still owed, she will have to come to some arrangement with them.

    if they cant, then, it may still technically be owed, but without any proof would be unenforceable.

    After following the advice from sourcrates, if the DCA is claiming they have proof she could request a copy of the CCA agreement for any consumer credit debts. The debts would be unenforceable unless a copy of the agreement with the correct terms and conditions can be provided.

    Also make sure they check Noddle too and order a £2 one off report from Experian. Not all companies report to all credit agencies. If they don't appear on any of the reports then the defaults will be over six years old (they are still owed debts they just don't appear on their file) they can either set uo another dmp with a FREE company or can send payments direct to the companies

    Also has your friend contacted harrington brookes to cancel her arrangement. They haven't just stopped paying?

    Only use the free debt charities, please.

    You do not get any more preferential treatment by paying for this service, she will just be wasting her money.
