Dmp - Northern Rock

I have a dmp with CCCS, but Northern Rock won't accept my offer and have taken me to court. Has anyone else had problems with them? They want a charging order on my property. Help!

    Maybe you should point out that our taxes have bailed them out recently.
  • If you have a DMP, fill in the admission form with your financial statement, and make the same offer in respect of NR as you have in your dmp. Attach a copy of your creditor list, and repayment schedule if you have one.

    The thing to remember before panicking too much is that if NR do not agree with how much you are offering to pay each month, it is not them who get to decide, but the district judge. Most courts will work on the same system of equitable distribution as debt management companies, and see that your offer is reasonable.

    If you get an amount to pay that is not what you wanted, or is for the whole amount 'forthwith' and not in instalments, you should very quickly fill out a form N245 to vary the judgment down to the amount that you can afford.     A charging order CANNOT be made if you have complied with the court judgment, which is why it is important to get the judgment right! This includes if you have got the N245 in before they apply for a charging order, but not if you got it in after they did.

    If it's all past that stage, and you have got the papers for a charging order, you can ask for conditions to be attached to it, e.g. that enforcement of the order be suspended while you pay £x per month towards the debt etc. Creditors are also meant to take note of any other creditors that have a potential interest, and this can be a defence to a full order being made, as usually they do not bother to check, so there are no other creditors listed on the form. In practice though, this just means a delay while the other creditors are given a chance to object, and they rarely do.

    If you have any problems filling out any of the forms, you could see your local CAB, or an advice agency.

    Yes my partner is having problems with NORTHERN ROCK too and they are doing th exact same thing to us. They actually obtained a CCJ without a hearing through there local court who has instructed my partner to pay x amout by the 4/10/07. They are fully aware of our out goings and we have recently had a budget review increasing our minimum payments. Then the other day my partner received a letter notifying us the case has now been transferred to our local court for appeal. So with a bit of luck they will be in our favour because we have made regular payments through CCCS. But the worst is a charging order on our property or attachment of earnings :mad:
    I totally understand your concern because Northern Rock do have a reputation for being unsympathetic to people falling on hard times even if it is due to serious illness etc.

  • i have had no problem with n/r accepting my dmp. infact they accepted within 2 months. saying that i was supposed to be paying £210 a month and the reduced payment is £127.

    gl with the courts there is some good advice here (as normal :-) )
