Forgot to cancel direct debit - refund?

Hi guys so I joined a gym October 2013. It was a three year contract I don't have a copy of the paper work. But basically I haven't used the gym in 14 months and didn't realise the 3 years was up until today. I've overpaid by a few months. I've written saying I want to cancel and they said it would be cancelled when they receive the final payment on the 8th of next month. If I haven't used the gym am I liable for a refund at all for the last few months I've overpaid my 3 year contract? Or should I even pay the next payment when I'm not even getting a service.

Any refund would be a goodwill gesture, and gyms are not known for giving them.
The three year term is a minimum, your contract does not end until you give one month's notice. Now that you have done that the contract will end after you have paid for the final month.
(And you are receiving a service, you've just failed to use it.)0 -
I suspect it became a rolling monthly contract after the three year period which you could cancel with a months notice. The 'service' was there for you but you chose not to use it.0

Hi, unfortunately you don't have much recourse here. Ask the gym for a copy of the paperwork, but I expect that it will be in your contract that the membership becomes a rolling monthly membership after your 3 year initial contract.
It's worth calling the gym up and asking if they will refund you. Explain your situation, be honest, be nice - it'll get you further than you think. But any refund you do get will be a goodwill gesture from the gym and they don't have to refund you anything.
Ultimately, within reason, it's up to the consumer to cancel an ongoing membership contract - the business is not a mind reader. Sorry it's not better news.0 -

No. These things are not fixed term contracts. They are rolling contracts with a tie in period. (unless you contract is unusual and says different)Or should I even pay the next payment when I'm not even getting a service.
