Help with the brick wall at the CMS

So I am encountering a massive brick wall when speaking with these people, I got a call from them recently asking for confirmation of residential contact which I confirmed. They then proceeded to tell me that the calculation had been redone and £x would be new figure, dropping his liability.

I asked for income based on which is less than half of actual income as based it on previous employment so I advised them of this change and person I spoke to said she would write out for new income confirmation. Great!!

Today I get another call calculation has dropped again, income consideration has been denied, why? Not enough evidence....what the?

So ex has new job since September 16 hasn't informed them of 100% increase in salary but happy to have it decreased on over night visits and I am being made to feel like a money grabbing ex.

How do I get the CMS to listen and actually do their job?

    What is their job?
    How do you know the NRP has had a 100% pay increase?
    The P60 dictates the CMS contribution.

    I know this because 1. He told me so himself exactly how much he was earning 2. He went back into a skilled job with a recognised standard minimum wage.

    Their job is to accurately calculate what should be paid to the children.

    I know this because 1. He told me so himself exactly how much he was earning 2. He went back into a skilled job with a recognised standard minimum wage.

    Their task is to calculate what is contributed to the PWC, this is often based on the most recent P60.

    If you have a level of communication and trust where he will happily tell you what he is earning so that you can compare it CMS assessments why not come to a private agreement instead?

    We don't really. He wont stick to a private agreement that's why cms are involved, he has another child whose mum only gets support from him when they got involved.

    So if you mention there is another PWC, then the contribution is obviously going to be less again than you may have hoped for.
    At best you may get 6% of the gross figure, but thats assuming that gross figure is what you believe it to be.

    Your payment will most likely be adjusted when they see his next P60 if he is indeed earning more.

    If he started a new job mid year his whole income for the total tax year won't be the full year on the new salary.
  • Will they review it again in April after he gets a new P60?

    Yes it's reviewed after the tax year (upon request)


    But it's a good point about 2 PWCs, have you considere dthis in your calculations

    From what I have read , only if the change is at least 25% of the original calculation.
