Attachment Of Earnings Discharged

Hi all,

Longtime since I have been on here and would like some information please.

I had an attachment of earnings applied to me a couple of years ago, and i have been bouncing from employer to employer (that changes next week!), just before Christmas I had a letter asking for an income and expenditures form to complete and send back with my current employers information, which I duly did.

This evening I have received a letter from the court stating that the following:

1: The attachment of Earnings is Discharged.

Please can someone tell me what this now means in relation to the debt?

    Hi there and welcome back,


    If this is for a county court judgment then it could be for one of several reasons. Assuming it is not because the debt is cleared; it may be that the claimant has decided this is no longer suitable enforcement action based on how often you move jobs and they are now considering alternative enforcement. That could mean using bailiffs. If that is the case you will get notice and can try and prevent this action by varying a CCJ.

    Can you please clarify if this is in relation to your previous posts and a CCJ or if it is something different?

  • Yes it was for a CCJ for a Credit Card debt. For around £900.
    I had several periods of unemployment, but did pay around £350 off of the debt.

    The full letter states:

    Before Deputy District Judge *********, in the County Court of etc etc, Upon the Defendant Having No Disposable Income

    It is Ordered that:

    The attachment of Earnings is Discharged

    Hello again,


    So, because your budget showed insufficient surplus to make a payment from your wage the court has determined that an attachment of earnings order is no longer suitable and it has been cancelled.


    This means the claimant could apply for alternative enforcement action - such as bailiffs. To try and prevent this you can apply to the court to vary the judgment with an N245 form, this can cost up to £50 to submit. You can ask for this to be discounted with an EX160. You will do another budget and make an offer to pay (minimum of £1 per month) and you should receive a response in the post about this. If you maintain the new payments the claimant cannot apply for any other enforcement. We have a factsheet about this: -
