Ethical Parking CBC and Brighton & Hove Council

Long time lurker on these forums since a run-in with CE (pre-POFA), but now in need of some advice, as I have offered to assist a friend who has received a CBC from Ethical Parking Management for parking in a residential area. I am waiting for the CBC (screen ticket) to get the exact details, which I understand was issued on 26th December 2016. I have advised that the keeper wait for the NTK, given that the 24-26 day period for a keeper 1st appeal has passed. Ethical Parking are under contract to Brighton & Hove County Council to provide parking management on a number of council owned residential sites, to which (from research) BHCC housing get 13% kick back from the paid charges.

Just to confirm, should the keeper use the standard template in the newbies stickies when the NTK arrives? I will visit the site in question to check signage etc.

As an aside, a resident has had a number of tickets issued to their (covered) motorcycle in their own space and I am hoping to get in contact with them as apparently they are going down the ignore route.

    so , to the OP, are you saying this is an ALMO that have contracted this PPC on behalf of the council ?

    Brighton & Hove City Council has a contract with Ethical Parking Management to provide enforcement on 56 of the identified 80 parking sites on housing land. The contract is concessionary as the council does not pay for this service but instead receives 13% the value of parking tickets which goes into the Housing Revenue Account.

    The latest proposal extends enforcement to 24 more sites.

    Shocking but true as far as ALMOs are concerned. But happily, Ethical are useless at POPLA and won't have a clue how to counter things like this not being relevant land because it is under Council control.

  • as the land is under Council control ethical have no right to get your data from the DVLA
  • Which leads to a DPA claim??? (I also read PP Blogs and look at PPP!!). The only possible fly in the ointment is that the vehicle is sign written (but registered to a private individual, not company), so they may take the easy route and use the details from that, although I guess this would shut off the keeper liability route?
