Working A Saturday Rota

Hi All,

Help required again regarding working a Saturday morning rota.

Last year my employer was asking me to work a weekend rota 2 in 4 Saturdays. I was not happy with this, and it got a bit heated, I put a post up about it & went to the CAB, basicly I was advised to negotiate which I did & agreed to work 1 in 4 Saturdays. this was agreed & I signed a letter which reads as follows.

"Dear *****
Thank you for agreeing to work on a rota, doing one in four Saturday mornings between 8am and 12.30pm.

In addition, if for any reason it was not possible to swap weekends with one of the people covering the weekend rota, then I will arrange alternative cover although this cannot become a regular thing. I can confirm that you would not need to use any holiday entitlement to cover any Saturday mornings.

Because nothing is changing with your employment duties, other than the extra hours, I feel that we can continue with your existing contract of employment in place. Therefore could you kindly sign one of these letters to confirm your acknowledgment of covering the additional hours above and keep a second copy for your records."

There were various discussions prior to this, but I signed & agreed to work the additional hours 1 weekend in 4. which I have done for the last year.

However, about 4 months after this, the manager who this was all agreed with left the company. The owner / company director, mentioned in a conversation about weekend cover & would like me to work 2 weekends in 4 "Mmmm here we go again". I explained that this had all been sorted out & that I was only willing to work the one weekend in four, to which he just said "I didn't want to discuss this know, you go away & have a think about it". So I just went away & left it at that.

Now just over a week ago, the foreman said that they want me to work 2 weekends in four, this has come from above. I explained that I did not want to do any more than which had previously agreed in Feb 2016, which was the 1-4 Saturday rota.

I have checked my contract of employment (very basic) which was signed in March 2003.
Hours of Work are stated as Mon to Fri 8am to 5pm 40hr week, Overtime when requested. There is a section to the side note 4a applies, which states "The hours of work stated are your normal working hours. At any time during your employment, upon reasonable notice your employer may require you to work additional or different hours. This section does not have a yes or no in it, as stated boxes marked with a * - enter YES or No.

How do I stand? what are my options? Any help would be greatly appreciated.

Regards

Is there any particular reason why you cannot work 2 out of 4 or is it just a matter of don't like it?

Following the last escapade did you consider joining a trade union?

  • Well I'm 50 & I like my weekends, but I do have two elderly parents, who are not as mobile as they use to be and am finding that they need me to do more & more around the house garden etc. working another Saturday will impact on how much I can do for them.

Could you take a half day 'in lieu' during the week and spend it with your parents ?

I sympathise - I worked full time and cared for my elderly Mum and it's quite a juggling act. A few hours to myself at the weekend was a blessing.
