6 year old default with O2 inc new CCJ from Lowell

Hi guys,

I had an account with O2 back in 2010 which I defaulted on for the amount of around £1100.

I had a default on my account with Lowell for around 5 years and then in September 2015, they put a CCJ against my name and credit report.

I never received any CCJ letter because I moved abroad from July 2015 until December 2016 just gone. As mentioned they put the CCJ against me during this period.

The original default has come off in December 2016 (last month) from my credit report but the CCJ is still on there.

I called O2 who actually told me that they are not sure why Lowell has the debt, and that the debt is indeed directly with them. They asked me to pay £5 of which I did to put something against the debt.

I was then told that I need to email the creditreferral team to ask about getting the Lowell CCJ off.

I've emailed the credit referral team five times with no response and had nothing back at all. The O2 support team will not give me a direct number to call the credit referral team, only an email address.

What are my best next steps? Obviously I never received anything on the CCJ at all as wasn't even in the country, and it must of all gone to my old flat.

Ideally I want to pay the debt to O2 as those are the guys the debt is with, but somehow I've been stuck with a CCJ from Lowell for another six years, not even mentioning the last 6 years of the default I had.

What should I do next? O2 are not responding. Are there any letters I should be sending?

    Something extremely odd going on here, i suspect 02 have sold the account on to Lowell, otherwise they would of been unable to petition the court for judgement.

    What the 02 rep has been telling you is incorrect, once a CCJ has been awarded, it cannot just be removed, unless you pay it in full within 30 days.

    In law, there is a procedure for everything, the only way to remove it now would be to apply for a set aside, you would need to fill in form N244, submit it to the court, along with the appropriate fee (currently £255,00) and the court will decide if you have good enough reason to set the judgement aside.

    The fact you were out of the country may not be considered a good enough reason, as you are supposed to update creditors with current addresses.
