Working whilst receiving SMP

Hi,


I am currently on maternity leave, although I have nearly finished my 39 weeks on SMP.


I have just acquired a part-time job which I will start on the 1st of February (3 weeks before my SMP is due to end).


I wont receive my first pay packet from this job until the 26th of February - a few days after I receive my final SMP payment.


I was just wondering if there are likely to be any repercussions from this from HMRC.

    It doesn't seem to matter when you'll get paid, but when you're doing the work.
  • I read this article myself before posting... what I was wondering though, was whether there would be any repercussions?

    You could be claiming a benefit/entitlement that you are not entitled to which is benefit fraud?

    It's up to you if you want to take the risk. You're probably better of just declaring it to who ever is paying your SMP and if they stop paying it for the few days there's an overlap (which judging by your post cannot be anymore than a month). Better to do this than have something unwanted arise out of it.

    It's your employer you need to inform, not HMRC. Unless that's your employer.
  • No HMRC is not my employer.


    So therefore would I be correct in assuming, if it is my employer which is paying SMP - it would not be considered a 'benefit' paid by HMRC, and therefore there shouldn't be any repercussions from them?

    Your employer claims most or all of it back from HMRC so there could be reprecussions from them

  • If you are still 'working' for the employer who is paying your SMP then I would make sure you don't do the part time job during the hours you are contracted for your main employer
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
  • is this a second job or replacing the employer who is paying you SMP? if it's a second job that you will keep when you return to your first job, make sure you're on the BR tax code!

    There won't be repercussions from HMRC but there could be from your employer as they'll be giving you money you wouldn't be due.
