dealing with robinson way dca

had a debt with barclay card defaulted. they sold it to mkdp llp who have sold it to hoist portfolio (robinson way)..debt for 3816. the debt is almost 5 years old have never entered into any sort of repayment plan with any of these companies.this has sat on my credit file gathering defaults every month.went for a rental property got declined because of this debt length of time no payments made etc etc...so tried to sort it out by offering a final settlement offer to robinson they declined saying they wanted 3k i offered 1500..they threatened to send court papers to me..after having made no contact with me for last 4 years thought that was rather rude..anyway question is what do i do next offer a small amount a month?to get them defaults from going on every month..have read about CCA request....have no idea what to do for the best....please any one got any ideas..thanks

You should do a CCA request yes.
That will benefit you in two ways, firstly the account will be put on hold until your request is sanctioned.
Second, they may not have the nessessary paperwork to enforce the debt.

You can make it clear you will either go on a debt management repayment plan, paying £1 per month, or you can pay the £1500 in full and final settlement. On the plan, even if you lived and kept paying for 50 years, the amount they'd get is still far below the settlement offer. There's nothing they can do if you're willing to pay £1 per month.0

defo gonna request a CCA..but now i have made contact can they push for a ccj?? and what will show on my credit file??when i start paying £1 a month0

Make up a list of other creditors amounting to roughly £100k suggest that you maybe be able to get some funds to try and settle in full and final from a family member and that your offer is pro rata'd across all your creditors and that some of them have already accepted and that your just waiting for them now so you can go ahead... If you need any more info let me know0

Despite the myths and rumors, court action is quite rare, but often used as leverage to get you to pay up.
There is no knowing if they will go down that route or not, all you can do is play the hand you are dealt to the best of your ability.
