problem with DCA satisfied default

I have been in talks with lowells to try and get the satisfied default removed from my credit file .

they emailed today to say they refuse to remove the satisfied default and asked what I am going to do with the other 2 defaults on my credit file?!

I have never mentioned any other defaults to them so i would like to know:

* How have they seen my credit file? they surely should only be able to see and change their own information.

they have mentioned this is an email which i have not given them permission to discuss anything but their closed and satisfied account.

due to this i need to know if i have a case now of data protection issues as they should not be accessing my credit file:mad:

  • thanks fermi but the debt was settled back in august so i would have thought they had no right to go through my credit file now

    I think it’s reasonable to assume that once the debt is paid off Lowell's rights under the contract cease. Fermi’s link actually says:

    ‘This gives the collection firm the right to access your credit report to assess your overall financial situation and to make appropriate decisions about engaging with you and collecting the outstanding balance.’

    Once there is no outstanding balance why would they need to access your credit file? I suppose Lowell could have accessed your credit file before the debt was paid off though. You can make a complaint to the Financial Ombudsman Service and Information Commissioner's Office to see what they say.

  • So I have just spoken with the information commisioners office who have said that as a debt collection agency they have signed up with a company that allows credit files to be looked at by companies so even if you dont have a debt with them they can look at every bit of our credit files not just their entries!!! This sounds so wrong to me! but the response was that the companies are strictly vetted to be able to do this.

    They might be referring to the fact that they can view all entries on your credit file once they’ve bought one of your debts, as we mentioned before. Otherwise it does sound a bit odd. Thanks for the update.
