The long term sickness doesn't change your contractual terms - on the other hand if you are being paid I'd imagine most employers would agree to waive the notice period as it means getting out of paying you for not working!Adventure before Dementia!0

contractual one week per full year worked, currently been on the books fifteen,I have not been paid only owed holiday,as instructed by employer,
The company was sold in 2013 and passed over to another company who kept previous staff,I have not signed any 'new' terms or new contracts, only thing been told is i can only have two holiday days per month.0 -
Is it capped at all? i.e. one week per year up until 4 years then 4 weeks?
If not it could be 15 weeks?0 -
dont think it is capped,im sure i read it was 15,online on the .gov page it says 12 is the maximum.0

AN employer must give you a weeks notice per year capped at 12 weeks. They can give more if they want to by putting it in the contract.
I cannot find anywhere that says that, where there is a contractual clause relating to notice, that this must be capped at 12 weeks.
Why don't you just speak to your employer, they may be willing to accept less notice?0 -
The employer since take over not spoke to them once, honest,I had to contact them as last company didnt inform me,all contact is now done by email, they have had health report on me,which they paid for aprt from that nothing.
No asking about any return to work or any thing about my health apart from a gp report.
So i cant understand why the company still has me on there books, all there loosing is out on is four weeks holiday pay a year, they do not pay me a monthly wage.
I getting that if they terminate my contract they have to pay me this contractual notice 'if' I terminate i get nothing apart from any holiday pay owing is this correct.0 -
If you're off on unpaid sick and remain off during your notice period (regardless of who served the notice) then you won't get paid. All you'll be entitled to is any untaken holiday that you have accrued.0

Is that correct, dont read like that on acas ?0

What's the ACAS link? You might not be able to post it, so add a couple of spaces.0
