Sorry for no response earlier. Been mad this end, trying to deal with my daughters autism and the system :-( they really do make everything difficult for my little girl and us! But will get there :-)
Just do your best with it and explain that without them giving you the right advice support it will not be accurate! But ensure you calculated everything as best you can. I am sure if you google changing weekly figures/monthly/4 weekly .... there is a calculator you can use to work it out for you! Put down everything like holiday fund, emergency fund, clothing etc and let me work out wether it's acceptable or not! Always go big and then you should find it easier to live etc. as they might just accept the figures, if not ask for reasons why they should be reduced! But bear in mind some figure they will want proof of etc!
Not encouraging you to lie, just saying add everything down your entitled to and let them decide if your allowed them all like the holiday fund and kids hobbies :-)
hope you child has a lovely birthday! Try little cut backs else where so you free up some funds for her special day!
Stay strong! Xx
I could be wrong but I think it stays on there up to 3 months after discharged. Not sure if should change and say "discharged" etc0 -
Not me work out if it's acceptable lol.......I meant them :-)0

Thank you for your reply. It's still showing me on there as bankrupt. Is there any reason I wouldn't have been discharged after a year do you know please?
The insolvency register will show you as discharged..this will continue to show on their register for three months after your discharge then it gets taken downNot quite a newbie as you think

Thanks for your reply Kerry. I'm sorry to hear that, and hope you get things sorted. I've heard similar from friends with autistic children. They don't like to make things easy.
Thank you for your helpful advice. We have managed to organise a little party for her with 11 children (including our 3), and have got her a 2nd hand bike which I think she'll love.
Ah, I thought it would say 'discharged' on the website. So it stays on saying bankrupt for 3 months and then goes? Why would I need to print it off, do people tend to ask for it?philnicandevan wrote: »The insolvency register will show you as discharged..this will continue to show on their register for three months after your discharge then it gets taken down
Thank you. So there's no way for me to see this? I'm paranoid that I haven't been discharged, is there any way to check?

Just to update. We requested a breakdown of the OR's calculations so we could work out the discrepancy. They replied to say that he had explained over the phone (my husband was driving and had to pull over at the side of the road) how the proposed IPA of £44 per month was calculated. And that if the figures were deemed to be too high, they would have adjusted them accordingly. So it seems that's what they have done. However as we were very honest about our spending, if they impose an IPA of £44 per month and we don't know which figures they are adjusting, where are we meant to find the £44 from? They threatened to take it to court when my husband questioned the figures. We have to submit another form for the proposed IPA and we're so confused now as we have no idea what they allowed and what they did not on the last one.0

Hi
Hope your well
I would email back advising them that you will not be able to commit/agree to the IPA until you understand where the adjustments were made.
Also state you need to know this or you are not able to reduce spending in those areas! How can you reduce an expenditure in order to make available surplus for an IPA, if you do not know what expenses have been changed!
Most people budget to what was stated on their SOA so it would make no sense that you would automatically have the spare cash for the IPA (unless you knew what areas had been reduced) inwhich you could then argue wether or not you are able to reduce spending in those areas that he has changed! Give reasons as to wether you are able or not to reduce that expenditure in those areas. Possibly try and negotiate an amount!
But it does sound like your OR is making things difficult!
It should be fairly simple for them to show you where the adjustments were made!
Also I would not sign until you have this info as he already state that he has included an emergency fund in your expenses. This would make a big difference in his figures and yours as you do not have one according to your records! Therefor we can only presume that we are not talking little pounds that have been changed! £10 pp is the normal amount for emergency fund and to still have £44 left over for an IPA and have an emergency fund, in comparison to your amounts is a big difference as you stated you only have £9+ without an emergency fund!
I think I remember their being 5 of you, so that's £50 emergency fund and his IPA amount of £44. That's roughly £100pm difference in your amount and his.
Hope you get this resolved!
Good luck0 -
Hi Kerry. This was the figures for the last proposed IPA which didn't happen because my husband changed jobs, so now we have to submit a new form. But yes, as you say we will be faced with the same problem if they reduce our figures again and don't tell us which or why. I almost feel like he's not telling us so that he can adjust them and we end up with an IPA. We have nothing against paying if we need to (we paid into an IVA for 4 years until my husband lost his job & it failed), but at the moment we honestly believe we don't have enough spare income (if any). I certainly don't feel like he's being very helpful (perhaps purposefully).
What is worrying me, is that in the phone conversation with my husband, when my husband questioned the fact they thought we had £44 excess funds per month, the OR said if we didn't agree it, it would just go to court. The thought of it going to court is now stressing me out.
Yes, it does seem like he made some big adjustments there. It's very likely the same will happen as we haven't made any adjustment in our spending, as we aren't aware we need to, or where we need to. I'll let you know what reply we get.
Thank you.0 -
I hear what your saying........ I believe you may be right, interms that OR is making things difficult.. Now sure how it would work going to court! But please do not give up! Email again and tell him that you need to know these answers!
Good luck xx0 -
Hello. Well, we've had a reply with a breakdown. The £44 has been shaved off the gas & electricity, so what we use we're not allowed that much (despite being on most expensive tariff as it's a pre-payment meter). How on earth are we meant to reduce that by £44, or should we challenge it and say we need the allowance upped? Is there a set allowance per person in a property, I wonder? Also, I was under the impression that you were allowed £20 extra expenditure per month before proposed IPA, but he hasn't allowed for this.0
-
That does seem harsh..are they aware you are on a pre payment meter?
If you have £20 surplus then they can apply an I.P.A...which would take the £20 also, so no you do not get the £20 its a trigger to start the I.P.A.
Also on you thread to stepchange I would imagine the fees to Weight Watchers would have to be found from what you are allowed in other areas.0
