Getting excess back from Drivers Insurance-his fault

My daughter had her car hit a couple of weeks ago and the chap driving admitted liability. She contacted her insurance who arranged to get the car repaired and arranged a hire car. They are now pursuing the drivers insurance company for payment. However my daughter had to pay the excess of £250.00 when she picked up the car from the bodyshop. When she spoke to Aviva ( her insurers ) they said she had to pursue the other driver for the excess.
Is this correct and if so how does she go about it?

Basically I would start by writing to the third party to tell them that you blame them for the uninsured loss (the excess).
I have in the past used this type of letter -
Dear <Insert Name of Other Party>
RE Accident <Insert Date of Accident>
I refer to the above accident and due to the circumstances of the accident I hold you totally liable for my uninsured losses.
Please forward this letter onto your own motor insurers in order that may communicate with me directly.
Yours sincerely
< Insert Your Name>
If they don't reply then I would send a more strongly worded version of this letter after 14 days.
If you already have the details of the other driver's insurance company then you should send them a letter like this -
Dear Sirs
RE Accident Date <Insert Date of Accident>
Your Policy Holder <Insert Name of Third Party
Your Vehicle <Insert Reg Number of Third Party Car>
I refer to the above and understand that you act on behalf of <Insert name of third party>
Please confirm that you have received notification of this accident from your policyholder and also that you are dealing with this matter on their behalf as I wish to make a claim for my uninsured losses.
I look forward to hearing from you at your earliest convenience.
Yours faithfully
< Insert your name>
Then they will write to you and you can tell them exactly what you are claiming for.
