About 8 years ago i took a loan out for a family member (no longer speaking with) of approx £900.00. I was under the impression it was being paid and paid off but i only found out it hadn't 3 years later when i tried to buy a TV on finance and was rejected. I had defaulted on the loan which i was very angry about. Anyway i haven't recieved any letters or heard from this debt and after 5 years the debt had come off my credit report.

I have now moved house and this is now 7 years later i have been getting letters from Robinson Way wanting me to pay nearly £6000.00(family member applied for further money maybe or debt agencies added premium i dont know???) i ignored this as i thought it was a scam. I have had letters every month wanting me to pay.

My last letter now this xmas this is coming to 8 years they have offered me 85% off my balance. I have until mid Jan to reply. It says it will show on file as partially settled and zero balance outstanding and not as settled (its not on file anymore as well over 5years old)
What should I do???. Do i pay up the 15% and get them off my back. Do i need to ask them for any paperwork or by me ringing them am i putting myself in it.
Thank you i am really worried and dont need this at this time of year.

Do you know when the last payment was made. Could the family member have paid something in the last three or four years?

A debt which is six years old or older is statute barred if no payment has been made towards the debt or an acknowledgement of the debt in writing has been made during the past six years.

If the debt falls into the above then it cannot be chased through the courts and to all intents and purposes is effectively written off.

    Hi,

Robinson way are most likely fully aware this debt is statute barred, (they specialise in this kind of debt hoping that you are unaware of your rights), hence the Hugh discount on offer.

You should send them the statute barred letter, and then let nature take its course, they must prove it isn't statute barred, you don't have to prove anything.

Further information here, and a link to a template letter to send to them :

Thank you all for your help.
We have not replied to any agencies recovering the debt as initially i thought they were typical scam or ppi type letters. Its only that Robson Way put the name of the original loan company that i twigged what it was for but these are very old.

I will not respond to the offer and send them a letter. Do you know what the worse can happen from the statute barred letter i will send please.

    Thank you

There is no worst scenario here.

If you've not paid for 7 years the debt is statute barred under the limitations act 1980.

You simply inform the creditor of this, they will look at the records, theses nothing they can do.

    Nothing at all !!!

Don't worry about it, send the SB letter, that should be the end of it.

    Happy new year !!
