Help with HCE

I posted on another thread and dacouch said I may find help on here for HCE specifically.

It is about a personal injury claim that went to court.

The problem I have is HCE keeps saying William Hill PLC do not believe me that I would be in financial difficulty if I was to pay them any more than £20 a month.
I have offered now to pay £100 a month but this is only with the help of my mother who will give me the remaining amount.

Each time that I have called HCE they do not seem to be helpful at all, and it feels like I'm talking to a brick wall. I called them today and I said I want to see if you will accept a higher amount, and the operator said, well we won't know. I trying to ask her for advice and then the line was quiet for a few seconds and she said can you put the new amount in writing.

I just put the phone down and emailed them.

They claim I owe £8000, but this is a ridiculous amount for solicitors to charge just to copy and paste templates and push papers across desks.

I really cannot pay £8000 at all, I have given HCE and their client a breakdown of my outgoings and incomings but they just want to keep quizing if I need to pay for things and quizing where payments are coming from. I was genuinely hurt, so that's why I put the claim in, but I feel they are trying to make an example of me, as I fit the demographic of the kind of person who tries to defraud the insurance companies.

But I am not the same, I am an honest person who goes to work, gets stuck in traffic for an hour each way comes home, has a bite to eat and goes to sleep. I don't have kids but that does not mean I have loads of money to spend.

I have 4 Payday loans companies that I need to pay back not to mention the money that I need to pay back for my wedding. They think I'm hiding money in my !!!! or something.

I really am at the end of my tether. I feel something needs to be done, but I would hate to think of the consequences.

    As a very very brief summary.

    The OP has made an injury claim against William Hill's motor Insurer, made a statement about the accident, the claim dragged on and the OP's solicitors changed. A revised statement was requested which WH disagreed with as they felt the information between statement 1 & 2 was different.

    It went to court which the OP was not aware of due to a change of address.

    They're now being (Aggresively) pursued by HCE on behalf of William Hill for all of WH's costs relating to defending the accident.

    They need help getting HCE accepting a reasonable payment plan and by the sounds of it handling their payday loans

    Thanks for the edited version.

    Do not speak to them on the phone again, dealing with these matters on the phone is seldom productive, as you have discovered.
    keep all correspondence in writing only.

    That way you cannot be influenced by there bully boy tactics.

    I assume they got judgement by default against you, due to not receiveing the court papers.

    You just deal with the court from now on.

    What you need to do now is to obtain court form N245 (application to vary a CCJ payment) fill it in, and return it to the issuing court.

    The judge will then decide a level of payment that's affordable to you.

    As for your other debts, have a look on the stepchange website, or give them a ring, they are a free to use debt charity.

  • Hi sourcrates, when I spoke to HCE and my insurance supplied solicitor they said you have gone past your 14 days appeal so I did not think I could contact the court again.

    Where can I obtain the N245 form and will this still be valid? Does it have to be the same court I was meant to attend? In this case Nottingham.

    You can ask to change the amount you pay per week or per month.

    To do this, fill in the N245 application form.
    Send to the judgement court.

    Give details of your income and spending, and say how much you can realistically afford to pay.

    You may have to pay a £50 court fee.

    If your offer is rejected, the court will decide on the amount you have to pay.
    You can also stop bayliffs visits with this form.

    Just an update. I filled in the form and sent to the court. I paid the £50 charge. Did this early Jan.
    Today I get a thick packet with a letter from the third parties Solicitors saying "this is what we are sending the court" and it's all the documents listed as "exhibit A" etc

    Not sure what is going to happen now, but what usually happens, does the judge overturn the verdict or will I still be in the same situation.

    While this is going on I have contacted the insurance broker and they are very happy to help get this resolved for me. Even though I am not a customer anymore (is this a normal thing?)

    What was worrying though is that Aviva who the insurance was under, had on their file that the "case was closed" and that "no action was taken by both parties"

    Then I was told that the claims company had closed the file also because they could not get in touch with you. (which is completely wrong as I have the same telephone number, and while this was all going on I was still at the same address).

    So this whole process seems to be broken. I'm not sure what we are paying for as consumers. Wrongly filed and half-assed chasing of information. It just feels like a money grab exercise.
