Need Help with CCJ (I think that's what it is)

    I've just got 5 mins between preparing the veg and sticking it in the oven.

    There's no rush for this. The only action Lowell MIGHT take is bailiffs and that's not a given. If they do the N245 has 2 boxes - suspend the warrant and vary the order.

    If they go down that route they will have to use the court bailiff who is a salaried employee and not usually too much trouble, and will have to give notice of the visit. That might be the time to use the N245.

    Now, roughly how much is it for to the nearest £100?

    If you did an income/expenditure statement (which is what the N245 is) how much surplus per month would you have? You say £12.50 per month, right?

    Do you have oher debts? If so how much roughly do they add up to?
  • I have everything written down for my expenses so I guess I put that in the form when I get one. Can I ask the court to send me a N245 because I have no way to print it out? When I contact the court do I tell them that the letter was delivered to me late and I never got any previous claim forms. I'm not always at the address they have listed because I'm having family issues and am currently moving around staying with friends and paying them rent and utilities so obviously nobody at my fathers house bothered to tell me there was a letter there and I only got it when I went to see my brother.
  • I have a personal loan that I'm paying back at £20 per week other than that I have a mobile phone contract where I'm paying back the phone at £13 a month. All of which are being payed back and have not gone to debt collectors.

    The debt is around £550 and that's right I worked it out at £12.50 and have taken no personal money at all for clothes etc.

    To be honest theirs not a lot Lowell can do to enforce this except, as Fatbelly suggests, send a county court bailiff round, at further expense to themselves, and as you are to all intents and purposes "of no fixed abode", and have few assets, there is precious little they can do.

    Now you've told us this, i wouldn't bother with the N245 yet, you could instead write and inform Lowell of your circumstances, that your unemployed etc, never received the court papers or the pre-action letter.

    Its possible they wont pursue it any further.

    They cant take what you dont have can they ?

    Now stop worrying about it, and enjoy your Christmas day !!!!

    On a £550 debt, £10 per month should be acceptable if necessary - it repays the debt in that 'reasonable period' of 3-5 years.

    And I'm not seeing enough debt to be thinking about a DRO or bankruptcy or even a debt management plan.

    I presume by 'personal loan' you mean loan to a friend. Unless it's massive, £20 per week is going to clear that soon and then maybe have a look at everything and post again.

    Now you know about the N245 you should find someone to print one off (it's double sided A4) and the EX160 fee remission form, so that if you need to use them you can. But it's now clear that none of the enforcement methods are going to work very well against you and Lowell would be stupid to spend more money trying to enforce a £550 debt.

    I agree with Sourcrates that you could let Lowell know that you are nfa, have no assets, no savings, own no property, don't work and are on a basic means tested benefit because of your disability.

    Think they might lose interest a bit.
  • I'm gonna contact them as soon as I can. I don't have a phone number for them but I think there's one on their website and I have tried emailing.

    Your best keeping this in writing to Lowell.

    If you ring them they will only attempt to coerce you into a payment plan you cannot afford.

    Keeping it in writing denies them that opportunity and makes it easier for you to get your point accross.

I will be calling them on Monday to tell them I will be paying by debit card as it's the first time I can get to a landline. Calling their number on my mobile will cost me money I don't have.

    You would be better getting a bank account that does standing orders and setting one up for £7 per month.

    Then forget about it as long as you can budget to stay in credit.
