Was i TUPED over ?

Hi all. Merry christmas to everyone !
I have a quick question i am concerned about.

Basically Does TUPE apply ?

I was under a contract with an employer and during this contract the employer went into administration.

All employees were informed and instructed of this change whilst it was going through administration and were instructed nothing will be affected i.e pay / employment.

I noticed a month down the line my wage slip payroll company name had changed and it continued with its new payroll name. I was still doing the same job in the same building , all unused holidays were able to be used as normal with the same working hours and hourly structure as per my original contract.

However, since the name change of my wage slip months went on and i was not issued a new contract and then i was made redundant.

Does this sound like a TUPE was used and should all my original terms and conditions still apply under the new company on the wage slip even though no new contract was issued ?

  • Sorry for a late reply, I have been away for Christmas.


    In the mean while, The new company has accepted liability for my redundancy pay meaning my length of service was carried over and therefore paid me 2 weeks redundancy pay. (in additional ) to left over holiday pay from the previous company too and any new holiday's I accrued during the new company.


    Specifically, I am trying to enforce the Length of the contract as it was for a minimum of 12 months it clearly states they can not terminate the contract before 12 months has elapsed. Unless for disciplinary reasons. which was not the reason for my dismissal.


    They new company have stated, this was not a liability taken on by them and to speak to the administrators of the old company.


    I don't understand how they have taken on liability for everything else in the contract but this section?
