In the absence of anything else forming the contractual pay, then the first payslip and payment if not disputed by either side would be the reasonable starting point at setting that part(remuneration) of the particulars of employment.
what it does not cover is what you do to get that remuneration unless there are details like fixed hours or other documented details like a rota.
The terms of the contract get formed by the actual actions.
The history of pay from then will determine what would be considered contractual.
Have you had 2 or 3 payments?
what is on the pay slips?
Now they can change those terms relatively easy and with less than 2 years service that can include the pay to the new pay they are saying you should be on.
All you can do is try to protect the need to pay back what they say they have overpaid but that could also result in them making the ultimate change you not having a job.
