Early Repayment Charge after Burglary

Hey all,
Hoping you can send some advice my way?
My house was recently burgled by my neighbour, to the point of the walls being damaged/partially pulled down in all rooms.
Total insurance payout was over 20k.
I have absolutely no desire to move back into that house and I plan to sell it as soon as it's repaired.
I expect to lose value on my house, thankfully it has increased in value apparently by 8k, so I'm hoping this might offset the loss.
I have to pay 5k to nationwide if I sell the house unless I purchase a new home, and honestly I don't feel ready to. I plan on renting and getting back on my feet again in a new area.
Do you think I have a chance of claiming back that 5k in damages? Nationwide unfortunately aren't willing to waive it so I'm hoping I might be able to take this guy to court for the loss?
Any advise would be greatly appreciated!!

Does he have 5k? Burglars tend not to have much cash to hand...
(I doubt it's a valid claim anyway, he hasn't forced you to sell your house, and it was your own choice to have a mortgage with an early redemption penalty)0 -

Not sure why you expect to lose value on the house? The insurance should have put the house back to how it was before the burglary.0

at least theft by a neighbour would not need to be be declared as a "neighbour dispute" on the sale documents0
