    Yes 100% formally with a settlement agreement reviewed by your wife's solicitor on their dime. And a copy of the reference.

    Personally, it's not worth the hassle at least she has a clear reference money and can enjoy Xmas without this hanging over her.

    Mixed feelings. She wants to clear her name but the offer is a hell of a lot better than what will happen if she's dismissed.

    The boss must be worried about something too, obviously they haven't turned up any problems with the books over the past week. Maybe he's starting to realise she's innocent, who knows.

    If she accepts should this be done formally with a settlement agreement?

    Technically yes but that would largely be to protect company. In theory without she could take the money and then still make a claim for constructive unfair dismissal. From her point of view all a settlement agreement would protect would be the reference. For a SA to be valid she would have to receive independent legal advice.
  • Jane called a solicitor and was told a Settlement Agreement is the way to go. She's emailed her boss and asked if he'd be agreeable to doing it that way.

    It does smart, knowing she's innocent. If this was to be decided by actual evidence rather than 'reasonable suspicion' she'd stay and fight, but the odds are so stacked against her she doesn't have much choice but to take the money and go with a clean slate.

    Make it 3 months and tell them it's a deal...

    Fact is there's bad blood there now, time to move on, but hard to get a new job over Christmas so extra time needed to get a new job...
