consumer credit agreement problems

I have an account with a dca called groundwell debt recovery who are constantly at me to pay a £150 debt from when i joined a book club.

A lady keeps phoning and i asked her for a copy of the cca and also sent them a letter. When i spoke to the lady she was very rude and said they didnt have one. From what i previously read I then said to her that surely she is not able to enforce this debt as she does not have a cca.

she then said that because i made a payment in the past then i have acknoledged the debt and the dca are not actually enforcing the debt they are just working on behalf of their client who is enforcing the debt.

Any help or advice on this subject would be great. Also have you heard any success stories on this matter.

I have a similar thing with hsbc. My account was moved to a managed loan about 5 years ago and it was done without my knowledge and i was told later of this so i never actually signed anything. This is now also with a dca and an original loan for £3,000 is now standing at about £7,500.

any help would be great.

    making a payment makes no difference to your entitlement to have a copy of the CCA agreement. It is your right and nothing they can say or do will change that.

    Write to them with £1 asking them for a true signed copy of the CCA. Happy to provide a template letter if you need it. Otherwise i'm sure soemone else will post it

    No CCA, DCA cannot enforce debt. If they are acting on behalf of the bookclub, the book club can provide the CCA.

    Or else.

  • Hi there, I'm also having trouble with these people. I'm being threaten with court and what-not. I'm suffering depression and this is just making it 10 times worse.

    You talk of CCA's. What are they and how will it help me? I really don't know what to do. I bought a couple of books from them. I got in debt with them because they kept sending me books I didnt ask for and they charged me to collect them to be returned!! And postage for sending books I didnt want in the 1st place!!I only owe about £20 from the books I havent paid for, and yet they're writing to me taking me to court for an outstanding balance of £50. How does that work? It's not fair and I really dont know what to do.

    Ive read reports about people who have gone down this route, not had evidence a CCA and then gone on to get there money back.

    Might be worth mentioning this, theyll prob drop it sharpish :)
