Need some advice re: online purchase

Sorry if this is posted in the wrong location, my first post....

I recently purchased a new blazer from a well known mens formal clothing company for a black tie event I have coming up.

The blazer was received and as I have long arms, I quickly checked it and got my tailor to collect it to lengthen the arms. She collected the jacket and returned it a few days later with the alterations being made.

This is when I tried it on with all of the trimmings and noticed that the collar was different to the picture on the website - a totally different style of collar. I checked the pictures online again and the cuff buttons and inner pockets were also different to the picture.

I did some research and found that I had actually been sent a jacket from last season, for this latest seasons cost. Obviously I am extremely unhappy with this and the company is refusing to exchange the item as its been altered. Apparently it is my responsibility to check the item thoroughly upon receipt - hence they have nothing they can do apart from a small refund on the price paid.

I feel really hard done by here, as I have paid for something that is not as advertised and I have also paid for alterations. I do not think the differences were significant enough to notice them on first glance, but nonetheless it is indeed a different jacket.

Is my only option here to start a small claims court proceeding? As the company are not playing ball at all - even thought they have "99% feefo" etc etc.

  • No. As you have altered the garment, you cannot return it. The onus is on the consumer to check they have been sent the correct item before using/wearing/altering.

    I think they have been generous to offer to refund you the difference in price.

    The issue I have is that the items are very very similar, it feels like they have tried to fob me off with an inferior product hoping I wouldn't notice.....

    The company was at fault making an error sending you the wrong item and you are at fault for getting it altered without checking. It sounds like the difference is not that significant otherwise you would surely have noticed when you originally tried it on. Accept the compromise, it is unreasonable to expect them to take back a jacket you have made unsalable.
