Hello, I’ll try to not make this first post too long without leaving out any facts that may help people respond.

So much information out there it’s about time I got some proper advice rather than conjecture.

Is erudios new ‘loan has matured, full payment is now required’ letter simply their current harassment letter doing the rounds and can this letter can be ignored?

Is erudio just a dca? If so what power do they actually have?

As much as I like ignoring them there has to be a better way. How do I legally make them stop the harassment and ever increasing interest charges?

I’ve been told there are a few things going on in the background regarding arrows and some of these matured SLC loans, anybody know what this means?

The loans are from 1996-2000 and I’ve never earned above the threshold.

My original loan total was approx. £6300, with added interest from SLC and their DCAs (credit solutions, buchanan, clark & wells) the total now is approx. £8300. This however, continues to change, as does the interest rate on every correspondence.

Including in August 2014 erudio reduced my balance, apparently due to errors relating to the CCA 1974. If they can change the figures this easily then are they just making the amount up, what do I actually owe?

I’ve moved around a lot and only have letters going back to 2010, nothing before and no original SLC contracts. Will SLC and DCAs have my correspondence history, will this be part of an SAR?

Thank you

Acknowledging it is making the monthly payment.

Looking through the paperwork I have the last contact from me was June 2012, until I made the mistake of replying to their maturity letter 3 weeks ago by telling them I've never earned above the threshold.

I presume that regardless of the recent reply it wouldn't have been statute barred because of the 2012 reply?

The only payments I've made were 6 months of £5 token payments some years before that.

As a DCA what power, if any do erudio have? Do I just ignore them and not start the DCA tennis match again?

I also presume there is nothing I can do about the interest charges?

Can I get an SAR from SLC, is this a useful tool?

    Many thanks

    Erudio are not a DCA.

If you always earn less than the threshold why not just keep them up to date with where you live and keep deferring?

SLC and Erudio have always had my addresses.

Up until now this is the 1st demand letter I've had from Erudio, so far it's just been statements/notices.

Haven't contacted Erudio until now as I've had my head in the sand, my debt, my fault, no one to blame but me.

    Always deferred with SLC.

'Erudio are not a DCA' ? Every article I read says they are?

I've tried registering online with Erudio, won't let me, say I need to ring them, nothing like wasting money on hold for nobody to answer.

Erudio bought a book of old-style (from courses which started between 1990 and 1998) student loans from the government in 2013, that doesn't make them a debt collection agency. Debt collection agencies are companies who specialise in collecting debts where the original creditor can’t get arrears repaid. The loans that were sold to Erudio were not in arrears, they were either being repaid or deferred. Do you have links to these articles which say otherwise?

Erudio just administrate the loans (badly) now. You can defer your loans with Erudio just the same as you could with SLC if you bother to complete the paperwork. It's no different to when SLC sold a bunch of the old style loans to Thesis Servicing years ago except Erudio's customer service is really crap.

So if Erudio do have your current address and you have been receiving statements and notices, have you been deferring?

Completing their paperwork is the issue though as it tries to give Erudio all sorts of rights that the original loans didn't grant them. Plus Erudio are a shell company owned by a DCA, so while they might not directly be a DCA they are one by proxy.

That's why I slapped them with a Statute Barred letter before anything else.

    Worth a try...

Is the best way to proceed as follows:

    1-submit an SAR to SLC?

2-submit an SLC deferment form to erudio and not a erudio deferment form

    3-submit a CCA to erudio

4-submit the 3 letters to erudio?
