Hi Guys,

I am a new poster to this site, so i beg your indulgence in my post.

I will start by saying that i am the kind of person that does not deal with debt well and kind of bury my head in the sand and hope it goes away, unfortunately i have learned that this is not the case.

Of late i am trying to get things sorted and get myself back on track. However on the 02.12.2016 i received a court claim form from a company called Shoesmiths acting on behalf of Capquest Investments looking to apply for a CCJ against me for a debt of £1207.84, also on top of the debt is costs in the region of £150.00.

I have acknowledge the claim form on line and have said i am going to defend the whole claim as i do not know where this has come from.

As above, I am unsure what this debt is for and have never received any letters in regards to this debt and i am unsure where it has come from.

Today 06.12.2016 i have sent letters to both aforementioned companies with a CPR31.14 request for original documentation of this debt and where it has come from.

I would ask if anybody can advise me if i have done the right thing and what kind of action i need to take if i do not received the request of info back etc. What would be the best way to see this thru until the end.

    Welcome to the forum. Requesting information on the debt was a good idea as you really need to see exactly why the claimant feels they have grounds to sue you. Is there any mention of what it is actually for in the particulars of claim?

    I think it’s worth checking your credit file held by each of the 3 credit reference agencies just to see whether there is any debt shown on there which you may have either forgotten about or may even be incorrect.

    Generally we recommend seeking legal advice when defending a court claim to maximise your chances of success.

    Thank you so much for your reply.

    There are no particulars of the claim on the court claim form i have received. I have signed up to Noddle for a free credit report and the debt is just in the name of Capquest, it does not give any more information than that.

    I was going to get legal advice, but that is something a cannot really afford. Is there anywhere you may know of that would give free legal advice.

    I meant to add, the particulars of claim should be sent to you within 14 days after the service of the claim form. Hopefully that will shed some light on the matter.
