Paid mileage and hours from home to site

Hi all,

Looking for some advice concerning the mileage and time from home to site. My company has recently brought in a new contract which we signed up to. In it, it stated that the first hour of travel to site and return to home was to be unpaid. We asked HR about this and was told that it was perfectly above board.

However since then it has become apparent that travel to and from home to a place of work other than an office where the employer does not have a fixed place of work (which is our situation) should be paid.

So question is are they allowed to do this and if not are they liable to pay back what they have deducted?

    yes I agree. But for the moment I would love to know if there is any firm rulings about this - Gov.uk seems to not have any guidance on the matter.

    This is exactly the kind of policy change a union would have fought against. But you have all signed the new contract and a union won't deal with a matter which arose prior to your joining it.
    Your company hasn't implemented an unfair term.
    But asking HR? Whose side do you think they're on?
